These terms cover the Breeze Client launcher and the Breeze mod (together, "the Software"), the Breeze store and online service, and the website breezeclient.net ("the Website"). "Breeze", "we" and "us" mean Breeze Client, which runs the Software, the store and the Website.
Acceptance
By downloading, installing or using the Software, or using the Website, you agree to these terms. If you do not agree, do not use them.
Eligibility and Minecraft
To play with Breeze you need a legitimate copy of Minecraft: Java Edition on a Microsoft account. Your use of Minecraft itself is governed by Mojang's and Microsoft's own terms, including the Minecraft End User License Agreement, which Breeze does not change. Breeze Client is not an official Minecraft product and is not approved by or associated with Mojang or Microsoft.
If you are under 18, or under the age of majority where you live, you may use Breeze only with the permission of a parent or guardian, who must agree to these terms for you and approve any purchase.
Your account
Your Breeze account is tied to your Minecraft account. You are responsible for what happens through it, so keep your Microsoft account and your computer secure, and tell us through a support ticket if you think someone else has used it.
Acceptable use
You agree not to:
- use Breeze to cheat, hack or gain an unfair advantage on servers that forbid it, or break a server's rules about modified clients;
- reverse engineer, decompile or modify the Software, except where the law allows it or an open-source licence that covers part of it says otherwise;
- use our services to spread malware, spam or illegal content;
- harass other players, or impersonate other players or Breeze staff;
- attack, overload or try to get around the security of our API or infrastructure;
- create several accounts to get around a ban or restriction;
- use our services for anything unlawful.
Purchases and refunds
Cosmetics are bought with Wind Charges, the balance in the launcher, which you top up through PayPal. Payments are processed by PayPal. Digital items are delivered as soon as payment is confirmed.
Wind Charges and the cosmetics you get with them give you a personal, limited licence to use them in Breeze; you do not own them as property. They have no cash value, cannot be exchanged for money, and cannot be sold or transferred to anyone except through Breeze's own gift feature. Prices may change; a change never affects a purchase already made.
If you reverse a payment through PayPal or your bank after receiving what you paid for, without a valid reason, we may remove the Wind Charges or items it paid for and suspend the account.
We offer refunds at our discretion for purchases made within 7 days if the item was materially misrepresented. We do not offer refunds for a change of mind. To ask for a refund, open a support ticket with the item and the date of purchase. This does not affect any rights you have under the consumer law of your country.
Cosmetics made by creators
Cosmetics in the store are made by Breeze creators, who keep their rights in their work and license it to Breeze for distribution. Creators must only upload work they made or have the right to use. Breeze may remove any item that breaks these terms or someone else's rights.
Third-party content
The launcher can download mods, resource packs and shaders from Modrinth and other sources, made by people who are not part of Breeze. Each comes under its own licence and its author's terms. Breeze does not check or vouch for third-party content, and is not responsible for it.
Suspension and termination
We may suspend or terminate accounts that break these terms, abuse the service or harm the community, and we may suspend an account while we look into a problem that puts players or the service at risk. Terminated accounts lose their purchased items and Wind Charges without refund where the law permits.
We may change, add or remove features, items and prices. If we ever stop the service as a whole, we will announce it on the news page first.
Intellectual property
Breeze Client, its name, its logo and its original content belong to Breeze. Minecraft is a trademark of Mojang Synergies AB. Open-source parts of the Software and the third-party software it uses are listed, with their licences, on the credits page.
No warranty
The Software and the Website are provided "as is", without warranty of any kind. We do not guarantee uninterrupted access, freedom from bugs, or that they will meet your needs. Keep backups of worlds you care about.
Limitation of liability
To the maximum extent permitted by law, Breeze is not liable for indirect, incidental or consequential damages arising from the use of our services. Our total liability is limited to the amount you paid us in the 30 days before the claim.
Changes to these terms
We may change these terms. Significant changes are announced on the news page, and the date at the top of this page is updated. Continuing to use Breeze after a change means you accept the new terms.
Governing law and disputes
These terms are governed by applicable law. If you have a problem with Breeze, write to us first and we will try to settle it with you in good faith. Nothing in these terms takes away a right the law of your country gives you, including the right to bring a claim in your local courts.
General
These terms and the Privacy Policy are the whole agreement between you and Breeze about the Software, the store and the Website. If a court finds part of these terms unenforceable, the rest still applies. If we do not enforce a term straight away, we can still enforce it later.
